Former President Trump's Team Seeks High Court Approval to Dismiss Top Copyright Director

The former leader's administration on Monday requested the nation's highest court to permit the termination of the head of the US Copyright Office.

This emergency appeal comes about six weeks after a federal appellate court in Washington ruled that the director, Shira Perlmutter, cannot be solely dismissed.

Almost one month prior, the full District of Columbia circuit court refused to reconsider that decision.

This case is the most recent in a series of cases related to executive authority to appoint preferred leaders at federal agencies.

The High Court has generally allowed such actions, even as court disputes continue.

However, this particular case concerns an bureau within the Library of Congress. Perlmutter acts as the register of copyrights and also advises the legislature on copyright issues.

The solicitor general, D John Sauer, argued in the legal document that, despite connections to the legislative branch, the register “exercises administrative authority” in regulating intellectual property rights.

Perlmutter alleges she was fired in May because the former president disapproved with recommendations she provided to Congress in a document concerning AI.

She reportedly received an message from the White House notifying her that her role was “ended starting at once,” as stated by her staff.

A divided appeals court panel decided that Perlmutter could retain her job while the legal dispute moves forward.

“The administration's alleged blatant interference with the duties of a Legislative Branch official, as she carries out legally authorized responsibilities to counsel the legislature, strikes us as a violation of the separation of powers,” stated Justice Florence Pan for the appellate panel.

Judge J Michelle Childs joined the ruling. Both justices were appointed to the appeals court by Democratic leader Joe Biden.

In dissent, Justice Justin Walker, a Trump appointee, argued that Perlmutter “uses executive power in a host of ways.”

Perlmutter's lawyers have contended that she is a renowned intellectual property specialist. She has served as copyright director since ex- librarian of Congress Carla Hayden appointed her to the position in October 2020.

The ex-leader appointed assistant attorney general Todd Blanche to succeed Hayden at the national library. The administration had fired Hayden amid complaints from conservatives that she was promoting a “progressive” agenda.
