US Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

Legal proceedings

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The situation stems from a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his return to the United States to face alien smuggling charges, he was held in federal detention.

In her order, the court pointed out that the government does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The court proceedings center on conflicting assertions. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.

Terms of Release

The court, who was overseeing his petition to removal in a federal court, ruled that he must now comply with the terms of his release from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.

This ruling marks a significant development in a complex legal case featuring claims of mistaken imprisonment and contested gang affiliations.
